Difficile de manquer cette affaire digne d\u2019un best-seller. Le proc\u00e8s de l\u2019un des plus gros cas de fraude aux \u00c9tats-Unis vient de commencer. Le r\u00f4le principal est interpr\u00e9t\u00e9 par Elizabeth Holmes, fondatrice de Theranos, une startup qui voulait r\u00e9volutionner les tests sanguins et la recherche en laboratoire. Une promesse r\u00e9volutionnaire port\u00e9e par une jeune fondatrice compar\u00e9e \u00e0 Steve Jobs et plus de 700 millions de dollars (602 millions d'euros) lev\u00e9s aupr\u00e8s de prestigieux investisseurs. De quoi enthousiasmer pendant plus de 10 ans toute la Silicon Valley. La v\u00e9rit\u00e9 a fini par \u00e9clater au grand jour : la technologie et les performances financi\u00e8res de la start-up biotech se sont av\u00e9r\u00e9es \u00eatre un mensonge.<\/strong><\/p>\n

Elizabeth Holmes avait pourtant tout pour r\u00e9ussir. Elle repr\u00e9sentait \u00e0 elle seule une success story made in America. La figure de proue d'un nouvel ordre d'entreprises num\u00e9riques et de startups \u00e9valu\u00e9es \u00e0 plus d'un milliard de dollars, les soi-disant licornes. Apr\u00e8s sa premi\u00e8re ann\u00e9e \u00e0 l'Universit\u00e9 de Stanford, elle a abandonn\u00e9 ses \u00e9tudes \u00e0 l'\u00e2ge de 19 ans pour se concentrer sur la cr\u00e9ation de sa propre entreprise, Theranos. Elle \u00e9tait l'une des plus jeunes milliardaires autodidactes des \u00c9tats-Unis. Elle risque aujourd'hui une peine de 20 ans de prison.<\/p>\n

Miser sur potentiel plut\u00f4t que sur les prototypes<\/h3>\n

Deux aspects rendent le cas Theranos int\u00e9ressant. Tout d\u2019abord, l'attention m\u00e9diatique d\u00e9mesur\u00e9e autour de l'ancienne PDG et les r\u00e9percussions du verdict sur les start-ups technologiques. Mais aussi de mettre en lumi\u00e8re les d\u00e9rives de la Silicon Valley. En un sens, il s\u2019agit aussi du proc\u00e8s de l\u2019un des aspects les plus pervers de la culture tech am\u00e9ricaine : vendre une id\u00e9e, plut\u00f4t qu\u2019un projet abouti.<\/p>\n

En effet, la Silicon Valley r\u00e9compense depuis longtemps les fondateurs qui exag\u00e8rent leurs concepts et concluent des accords sur le potentiel plut\u00f4t que sur des prototypes. C'est ainsi que sont n\u00e9es la plupart des soci\u00e9t\u00e9s les plus puissantes de la Vall\u00e9e. C\u2019est la c\u00e9l\u00e8bre doctrine \u00ab Fake it till you make it<\/em> \u00bb (Faites semblant, jusqu\u2019\u00e0 ce que vous y arriviez).<\/p>\n

\u00ab th\u00e9ranostication \u00bb<\/h3>\n

L\u2019ampleur m\u00e9diatique de l\u2019affaire est telle que le magazine Wired \u00e9voque une \u00ab Theranostication \u00bb. Et pour cause : l'histoire d\u2019Elizabeth Holmes a d\u00e9j\u00e0 laiss\u00e9 une marque ind\u00e9l\u00e9bile non seulement dans la Silicon Valley, mais aussi dans la culture am\u00e9ricaine. Des articles de magazines, un livre \u00e0 succ\u00e8s, une s\u00e9rie de podcasts, des documentaires, une s\u00e9rie t\u00e9l\u00e9vis\u00e9e et un film sont d\u00e9j\u00e0 sortis ou sont en cours de pr\u00e9paration. Difficile dans ces conditions de rester impartial, y compris pour le jury qui a \u00e9t\u00e9 extr\u00eamement difficile \u00e0 s\u00e9lectionner.<\/p>\n

Theranos restera dans l'histoire comme l\u2019une des plus grandes fraudes du milieu biotech impliquant plus de 700 millions de dollars d'investisseurs dup\u00e9s, ainsi que de nombreux patients ayant subi des dommages physiques, mentaux et financiers. Mais n'oublions pas que de nombreuses entreprises technologiques ont pr\u00e9c\u00e9d\u00e9 celle d\u2019Elizabeth Holmes. Il n\u2019\u00e9tait pas question de fraude \u00e0 proprement parler, ni de tromperie, mais de discours marketing et de feuilles de calcul pour les investisseurs. Apr\u00e8s tout, les promesses du portable Healbe GoBe, ne sont pas si vieilles\u2026 Tout comme la publicit\u00e9 d'un million de dollars pour Scanadu Scout, un appareil frontal pr\u00e9sent\u00e9 pour mesurer la tension art\u00e9rielle, la fr\u00e9quence cardiaque et le niveau d'oxyg\u00e8ne en quinze secondes\u2026 Finalement, le dispositif m\u00e9dical n'a jamais \u00e9t\u00e9 mis sur le march\u00e9 et n'a \u00e9t\u00e9 produit qu'en \u00e9dition limit\u00e9e dans le cadre d'un projet de financement participatif.<\/p>\n

Question de perspective ?<\/h3>\n

Le scandale de Theranos met aujourd\u2019hui au pilori \u00e0 la fois une entreprise et un fondateur. N\u00e9anmoins, la d\u00e9cision du jury et du juge remettra probablement en question la culture am\u00e9ricaine des startups, qui attend des fondateurs qu'ils poursuivent leurs id\u00e9es co\u00fbte que co\u00fbte. \u00ab L'\u00e9chec n'est pas un crime<\/em> \u00bb, a d\u00e9clar\u00e9 Lance Wade, l\u2019avocat d\u2019Elizabeth Holmes, lors de sa plaidoirie d'ouverture avant de poursuivre \u00ab Faire de son mieux et ne pas r\u00e9ussir d\u00e8s le d\u00e9but n'est pas un crime<\/em>. \u00bb<\/p>\n

Une philosophie qui n\u2019est pas partag\u00e9e par le procureur en chef, Robert Leach, charg\u00e9 de l\u2019affaire. Selon lui, derri\u00e8re l\u2019incroyable succ\u00e8s d\u2019Elizabeth Holmes \u00e9taient dissimul\u00e9s de s\u00e9rieux probl\u00e8mes pr\u00e9judiciables. Le jury devra donc d\u00e9terminer \u00e0 quel moment la start-up est devenue une fraude. Quand sa vision a-t-elle mal tourn\u00e9 ? O\u00f9 s'est termin\u00e9e la pr\u00e9sentation ambitieuse des chiffres de ventes attendus et o\u00f9 ont commenc\u00e9 la tromperie et les manipulations d\u00e9lib\u00e9r\u00e9es ?
